August 26, 2022
On August 9, 2022, an updated schedule of monetary penalties for cannabis came into effect. The updated schedule was established by the Board of the Alcohol and Gaming Commission of Ontario (AGCO) and approved by the Attorney General of Ontario.
The schedule was updated to reflect statutory and regulatory amendments that came into effect in March 2022, enabling cannabis retail stores to offer delivery and curbside pick-up services on a permanent basis.
Monetary penalties are one of the compliance tools the AGCO may use when licensed operators, retail store managers or authorized stores are found to have acted outside of compliance with the Cannabis Licence Act, 2018, its regulation or the Registrar’s Standards for Cannabis Retail Stores. Monetary penalties are a step towards ensuring compliance and allow the AGCO to take appropriate regulatory action, in the interest of Ontarians, that is greater than a warning but not as severe as a licence or authorization suspension or revocation.
The penalty ranges are designed to address the specific risks posed by each infraction and by the different licensees and authorization holders. It is important to note that the amounts listed in the schedules are maximums only and that penalties assessed may actually fall lower in the potential range, based on individual circumstances.
