On Friday, September 27, the Ontario Superior Court of Justice dismissed the application for a Judicial Review brought by certain disqualified applicants and lifted the temporary stay it ordered, allowing the Registrar to continue the cannabis retail store licensing process.
On Monday, September 30, the parties filed a Notice of Motion for Leave to the Ontario Court of Appeal, as well as a Motion seeking a new interim stay pending the determination of that Leave to Appeal. The Motion for the stay was heard by the Ontario Court of Appeal on Tuesday, October 1.
On Wednesday, October 2, the Ontario Court of Appeal dismissed the motion for a stay. The Motion to seek Leave to Appeal will be heard at a later date yet to be determined. The AGCO will make no further comment on any active proceedings.
Our focus remains on moving through the lottery and licensing process as quickly as possible while continuing to apply our rigorous licensing approach in order to allow for the opening of safe and responsible cannabis retail stores.
