On Friday, September 27, the Ontario Superior Court of Justice dismissed the application for a Judicial Review made to it by certain disqualified applicants.
The AGCO has been very careful to ensure it is running a fair lottery process and administering the lottery rules with the utmost rigour. We have worked closely with KPMG, our external fairness monitor, to ensure fairness for all who participated in the lottery or considered participating. This includes those who were selected and those on the wait list.
The Court has lifted the temporary stay it ordered. The AGCO will now proceed with the assessment and eligibility review of the licence applications it has received. We will be communicating revised deadlines to the applicants who were brought forward from the wait list to replace those who had been disqualified.
Our focus remains on moving through the lottery and licensing process as quickly as possible while continuing to apply our rigorous licensing approach in order to allow for the opening of more safe and responsible cannabis retail stores.
