February 27, 2023

The Alcohol and Gaming Commission of Ontario (AGCO) would like to inform all liquor licensees that on February 24, 2023, an updated schedule of monetary penalties for the liquor sector came into effect. The updated schedule was established by the Board of Directors of the AGCO and approved by the Attorney General of Ontario.

The schedule was updated to reflect recent regulatory amendments relating to the Caterer’s Endorsement to a Manufacturer’s Licence and the new approval framework for temporary outdoor physical extensions of premises (temporary patios) and to address breaches of a condition on a licence or permit.

Monetary penalties may be imposed by the Registrar after a warning is issued, prior to potential revocation or suspension of a licence.

The amounts listed in the schedules are maximums. The penalty assessed may fall lower in the potential range, based on individual circumstances.

Any licensee or permit holder may appeal an order of monetary penalty imposed by the Registrar to the Licence Appeal Tribunal, which may uphold or set aside the monetary penalty for the infraction.
