Expression of Interest Lottery Selection Results
As set out in Ontario Regulation 468/18, the Government of Ontario gave the Alcohol and Gaming Commission of Ontario (AGCO) the mandate to hold a lottery to determine who may apply for Retail Operator Licences. The lottery selection was completed on January 11, 2019 at 3:16 pm EST.
Eligible Expression of Interest Application entries were placed in a common pool and randomly selected using a third-party-certified AGCO lottery software program. KPMG, in its role as fairness monitor, was present to monitor the lottery to assess whether it was conducted fairly and according to the Expression of Interest Lottery Rules.
Expression of Interest Applicants should have their AGCO file number that was provided in their Application Confirmation email available when checking the lottery results. If you have a question about the lottery results please submit your inquiry via the iAGCO inquiries portal.

The Expressions of Interest (EOI) Applicants for each Region that were selected in the lottery. Those on the Selected List for each Region will receive a Notification Letter from the Registrar that will confirm their selection and outline the next steps including how to make a Retail Operator Licence application to the AGCO.

The first 20 EOI Applicants drawn on the Wait List for each Region. As set out in Lottery Rule 17, an EOI Applicant that is first on a Wait List for a Region will be moved to the Selected List for that Region if a selected EOI Applicant for that Region is disqualified from the Lottery Process by the Registrar, declines the opportunity to make a licence application, withdraws their EOI Application, withdraws an application for a Retail Operator License, or has their Retail Operator License refused or revoked by the Registrar.
Once the AGCO has verified the disqualification or withdrawal of a selected Expression of Interest (EOI) Applicant, AGCO will contact EOI Applicants on the Wait List by email. Those Applicants will be provided a Notification Letter, consistent with EOI Lottery Rule 15.
Applicants on the Wait List should be prepared to meet the requirements of Lottery Rule 16 and the Notification Letter will clearly set out equivalent durations for the timeline expectations, including the application submission timelines and the schedule on which the standby Letter of Credit will be drawn down, consistent with EOI Lottery Rule 18.
Finally, AGCO has been clear that interested parties to the Lottery Process should be prepared to open a cannabis retail store on April 1, 2019, and that the Lottery Rules were established with that intent. Any exercise of the Registrar’s discretion with respect to Rule 16a will be on a case-by-case basis.

During the Lottery Process if an Expression of Interest Applicant on a Wait List for a Region is moved to the Selected List for that Region, as set out in Lottery Rule 17, the table will be updated.

This Lottery results list contains all entries by region in the order in which they were selected for which applicants expressed interest in the cannabis retail expression of interest lottery. It includes each Applicant’s legal name, and the iAGCO file number.
An applicant who indicated interest in multiple regions will have multiple, separate entries on this list (i.e., one for each entry).
Please note that this .csv file will be amended from time to time to reflect the removal of names from the wait list in accordance with Rule 13 c) ii). Those choosing to exercise this option will no longer be considered for the opportunity to apply for a cannabis retail store during the time period covered by the Lottery Process.
As part of ongoing due diligence, the AGCO has conducted a review of the Expressions of Interest (EOI) that had been submitted after the close of the EOI Application window on January 9, 2019 and before the Lottery was held on January 11. Clear violations of the Lottery Rules were identified and reviewed with KPMG, the Fairness Monitor for this Lottery Process. Those Applications were disqualified and were not included in the Lottery. Disqualified Applications do not appear on this list but can be viewed in a separate list on the AGCO website.
In cases where there may be violations of the rules that could not be confirmed with certainty, the Applications were allowed to remain in the Lottery. All Applications that appear under the Selected list within a Region will undergo a thorough eligibility review, including for compliance with the Lottery Rules. In addition, as set out in Lottery Rule 2, EOI Applicants in the Lottery Process who are selected to apply for a licence must use the same legal name and applicant type identified on the Expression of Interest Application in their Retail Operator Licence Application.
As set out in Lottery Rule 5, at any time during the Lottery Process (January 2, 2019 to December 13, 2019), if the Registrar determines that an Expression of Interest Applicant has not followed the requirements in Ontario Regulation 468/18, or the Expression of Interest Lottery Rules, that Applicant will be disqualified from the Lottery Process. Any pending application for a Retail Operator Licence will be considered abandoned. If a Retail Operator Licence has been issued, the Registrar will revoke the licence.
