Issue:

What is a “court order condition” and how might an Operator or the OLG find out about one?

Response:

There are a variety of reasons that the courts might impose conditions on an individual restricting access to gaming. Some of the most common cases would be conditions of release, sentencing/probation, or conditions of parole. Court-ordered prohibition could also be used for insolvency and bankruptcy matters or other civil proceedings.

There may also be a variety of methods through which the OLG or an Operator could learn of a court order condition. For example, information could come from the AGCO/OPP, through a lawyer to the OLG Legal Department, or even through a more subtle source (e.g., internal discussions). Whichever the method, the OLG or Operator is responsible for restricting access to any individual who is known to be restricted by a court order, according to Standards 3.1 and 3.2 of theRegistrar’s Standards for Gaming.

3.1 Only eligible individuals are permitted access to a gaming site.

Requirements – At a minimum:

  1. A policy on eligibility of access to the gaming site, play and payment of prizes shall be established, implemented and made public.
  2. The following individuals shall not be permitted access to the gaming site:
    1. An individual who is known by the Operator to have been restricted from accessing the gaming site or playing a lottery scheme as a condition of a court order;

3.2 Only eligible individuals are permitted to play a lottery scheme.
